Building Use Agreement


ELK CREEK TOWNSHIP HISTORIC BUILDING
This agreement sets forth the terms under which the Elk Creek Township Historical Society and
the Elk Creek Township Supervisors allow the use of the building and the adjacent parking area.

TERMS OF THE AGREEMENT
1. No alcoholic beverages are permitted anywhere on the premises, either inside or outside
the building.
2. No smoking is permitted inside the building. If smoking takes place outside the
building, the user will be responsible to insure that the smoking materials and means of
ignition are completely extinguished.
3. Candles ma;y be used inside the building provided they are stationary and not left
unattended.
4.. Light refreshments such as sandwiches, salads, cookies, etc. May be served. Coffee may
be made and appliances used to keep food at serving temperature, however the user is
responsible to insure that the circuits are not overloaded.
5. Users are permitted to decorate the building, but must ger advance permission for the
placement of any decorations which include tacks, nails or tape.

6. Because the buidlding has great historical significance and many of the contents are
irreplaceable, all users must maintain and preserve the historic atmosphere of the
building. Users will be held monetarily liable for any and all items which are damaged,
broken or removed from the building during their period of use. Except with respect to
groups which use the building on a regular and repeated basis and then only after
approval of the society a member of the Elk Creek Township Historical Society must be
present during all activities at the building.
7. Following the use of the building, the premises must be returned to the condition prior to
date of use and all trash, debris and decorations, etc are removed.
DONATION FOR USE OF THE BUILDING
To defray the costs associated with the maintenance, insurance and upkeep of the building, the
Elk Creek Township Historical Society requests a donation of $50.00 for each use of the building.
During the heating season, there is an additional minimum donation of $10.00 to defray the cost of
heating the building. The heating donation also applies for each time the building is heated to prepare
for the function (i.e. decoration, rehearsal, etc.) The heating donation is increased at the rate of $2.50
per hour for each hour over four hours for which heating is needed in a continuous period of time.
SECURITY DEPOSIT
When the building is reasonably expected to be used by 15 or fewer persons, a $50.00 security
deposit will be required to be paid at the time arrangements are made for the use of the building. When
the building will be used by more than 15 persons, the security deposit will be $100.00. The security
deposit amount in no way limits the liability of the user for costs associated with either the
maintenance, insurance and upkeep of the building, cleaning of the premises, or repair of damage.
SECURITY DEPOSIT REFUND
The security deposit will be refunded within 30 days of the use of the bilding provided the
following conditions are met:
1. The building is cleaned and cleared of any debris, decorations and litter.
2. No loss or damage has occurred.
3. A photo or snapshot of the event (or couple) is provided to the Elk Creek Township
Historical Society.
WAIVER OF DONATION AND SECURITY DEPOSIT
The Elk Creek Township Historical Society may waive the donation and security deposit for a
one-time use of the building by a non-profit community group. A boy Scout or Girl Scout Troop or like
group provided that at least one-half of the members are residents of Elk Creek Township

I have read and agree to abide by all of the above terms. If this agreement is being executed by a
representative of a group, the undersigned also affirms that he/she is authorized to sign this agreement by
the group intending to use the building, and that the group will abide by the terms set forth above.
